Accident & Injury Claims

Compensation for an accident isn’t a fixed sum. It varies from person to person and from accident to accident. You receive a sum of money (known as general damages) for the actual pain and suffering caused by the accident and then a separate sum (known as special damages) to cover the direct financial consequences of the accident. Only the general damages should be similar from accident to accident - there is a “going rate” for a broken leg, an eye or an arm. 

The “special damages” depend on your personal circumstances and vary from person to person. They are often the largest part of any claim and can include loss in wages whilst you are off work, the wages you will lose for the rest of your life if you are disabled by the accident and have to either stop work or work in a lower paid job, the cost of medical and rehabilitation treatment and, in serious cases, the cost of someone to care for you or perhaps to carry out tasks (gardening, washing, DIY, etc.,) that you are no longer able to do.

One of the main parts of a solicitor’s job in maximising the compensation you receive is to look at your injuries and personal circumstances and identify every single item of loss that you have suffered. For instance, someone keen on DIY who does their own house and car maintenance, could quite easily receive an additional £10,000 - £20,000 if their injuries prevent them from doing this. Once the solicitor has identified the items, he then has to work out how much is needed to cover the cost of each item. 

In serious cases, this can be a very painstaking business - imagine your hearing is damaged in an accident and you need a hearing aid for the rest of your life, even the cost of the batteries each month needs to be included.
