No Win, No Fee - Funding Your Claim

All our accident claims are dealt with either under "no win, no fee" agreements or under your own legal expenses insurance policy. The result is that claims can normally be pursued at no cost to you.

Before entering into a "no win, no fee" agreement we are required to check whether you already have any legal expenses insurance. It is now common for this to be provided as an "extra" on household and car insurance policies. It is also included with some credit cards.

Cheap or free legal expenses insurance may sound too good to be true and in some ways it is. Many insurance policies contain a restriction that you can only use the solicitor appointed by the insurance company. Many insurance companies now sell claims to large "factory" firms of solicitors all over the country. The result is that you could end up with your claim being dealt with by a solicitor miles away who you will never ever meet.

If my legal expenses insurer sends me to a solicitor miles away - do I have to use them?

This is something we hear all the time. You have an accident and the next thing you know is you are contacted by a solicitor at the other end of the country who you haven’t heard of saying they have been appointed by your Legal Expenses Insurer!

In many cases you do not have to accept this and, in fact, if legal proceedings need to be commenced, the law now gives you the right to choose your own solicitor and even change to a new solicitor if you do not like the solicitors appointed by your Legal Expenses Insurers.
